Counsel for the plaintiff (ADOR) first explained the basis of its claim for contractual penalties and damages. The plaintiff stated, “On the morning of March 21, 2025, the first-instance court issued its decision on the injunction regarding NewJeans’ exclusive contracts. The result was unfavorable to the NewJeans members,” and then referred to “a conversation exchanged that evening by Min Heejin and others” through Telegram messages.

According to the plaintiff, after ComplexCon in Hong Kong, discussions were underway to proceed with a music video shoot involving a featuring collaboration with the American band Emotional Oranges. The plaintiff stated that contracts were being prepared, that the music would be released on May 16, 2025, and that artist fees totaling US $175,000 had already been paid. The plaintiff argued that this showed “they had absolutely no intention of accepting or complying with the injunction decision.”

The plaintiff further referenced statements allegedly made by Danielle’s mother, such as “Let’s backdate the contract signing date to before the injunction ruling,” or “Let’s receive the payment through Danielle Marsh’s older sister’s business entity.” The plaintiff argued that these remarks clearly demonstrated that, despite the injunction ordering compliance with the exclusive contract, there was “absolutely no intention of following the court’s decision and instead a clear intention to continue violating the contract.”

The plaintiff continued:
“ADOR only learned of these matters later, and considering the seriousness of the violations, concluded that it could no longer continue its contractual relationship with Danielle’s side and therefore issued a notice of termination.”

The plaintiff added that Danielle’s alleged violations included an Omega contract and numerous other agreements, but stated that those would be omitted from discussion at this hearing.

The plaintiff also said:
“The defendant (Danielle) has repeatedly argued in this lawsuit that Danielle’s entertainment activities would be suspended. However, Danielle is free to continue her entertainment activities. There is absolutely no reason for the plaintiff to interfere. We do not understand why they continue making that argument.”

The plaintiff explained that it is seeking payment of contractual penalties for Danielle Marsh’s alleged breach of the exclusive contract, as well as damages for harm to the company’s reputation.

In response, Danielle’s side argued:

“The plaintiff raises the issue of the collaboration with Emotional Oranges, but the NewJeans members believed that the exclusive contracts had been terminated because the plaintiff failed to fulfill its duty to protect the artists. Once they gave notice of contract termination, it was only natural that they planned to carry out activities outside the plaintiff’s management.”

Danielle’s side maintained that Danielle believed the contract termination had been legally effective.

Danielle’s representatives also argued that most of the matters at issue, including ComplexCon, involved the other NewJeans members as well. They emphasized:
“It is incorrect to claim that Danielle alone committed unlawful acts and therefore cannot continue the relationship, based on peripheral issues such as the Emotional Oranges matter.”

They further stated:
“The plaintiff seems to be referring to the ELLE photoshoot and the Emotional Oranges matter, but in reality none of those things actually took place. After the court ruling, these activities could not even be initiated anymore. These are events from the past, yet the plaintiff says they should be corrected. We asked how we were supposed to take corrective measures, but the plaintiff simply responded that ‘the defendant should figure it out’ and unilaterally terminated the contract.”

They added:
“The plaintiff is portraying it as though Danielle alone did something different from the other NewJeans members, but there are only a few examples being cited, and none of them were particularly extraordinary.”
