The court has acquitted a man who was brought to trial for purchasing a photograph in which the face of a minor female celebrity was superimposed onto a n*ked female body.
On the 8th, the 1st Criminal Division of the Cheonan Branch of the Daejeon District Court (Presiding Judge Jo Young-jin) acquitted A (in his 20s), who was indicted without detention on charges including violation of the Act on the Protection of Children and Adolescents from S***al Exploitation (production of s****al exploitation material).
A was accused of purchasing a photograph for 20,000 won in which the face of a female celebrity was superimposed onto the n*ked body of another woman.
According to the Act, purchasing, possessing, or viewing material that can be clearly recognized as depicting a child or adolescent is punishable by imprisonment for a term of at least one year.
The prosecution viewed the photos possessed by A as child and adolescent s***al exploitation material because they featured female minors, but the court’s judgment differed.
The court ruled, “The composite photos in question do not feature actual child and adolescent victims directly, but are merely images created using the victims’ faces,” adding, “There is no possibility that this constitutes child and adolescent s***al exploitation material as defined by law.”
The court further stated, “The fact that the victimized celebrities are members of idol groups cannot be definitively concluded as a common knowledge that they are children or adolescents under the age of 19, and the quality of the images is poor, making it easy to recognize them as composite photos. This is not a matter punishable under the applicable laws,” and acquitted him.
